Treason is an act of disloyalty to one's own country. Foreign nationals snatched in Afghanistan (usually kidnapped up by local tribesmen for a hefty bounty) are not U.S. citizens, and therefore cannot be "treasonists."

Americans. There are many civil libertarians (NRA and ACLU, famously) who view that law as an assault on the Constitution.
You, like many other BushCo apologists, make the fundamental mistake of confusing shameless politically motivated fearmongering with vigilance. Protecting America isn't a short-term thang. It must be done with the utmost respect for the Constitution and complete awareness of the long-term ramifications of short-term actions.
