buzz viewers who understand 1976 copyright act
My name is Gerard, I paddle and make youtube videos.
Most videos I post use mainstream music and eventually get flagged for copyright infringement. I dispute the record companies claim citing that it is an educational video that is not for profit and is incidental background music. Every-time I have done this the record companies accept my dispute and the block or flag goes away.
A couple weeks ago I made a video using "Lonely Boy" from the Black Keys. It got flagged, I disputed it, and the record companies allowed me to stream the video. Since "Lonely Boy" has gotten huge and has been on a late night show every night. It got flagged again this time youtube stated that WMG would be forced to sue me if I appealed the decision. I think my use of their material falls under "fair use" but don't really feel like dealing with a pissed off corporation for a niche video that most people won't find all that interesting, if I'm gonna get screwed for disputing their claim again.
I know some lawyers look at the buzz and would appreciate any advice as losing this battle will probably relate to future videos and users other then myself.
