As soon as this afternoon, the U.S. Senate may be voting on the Energy and Water Appropriations bill, and an amendment is being offered by Senators Barrasso and Heller that would undercut Clean Water Act protections for many streams across Colorado and the nation. Please call Senators Udall and Bennet at the numbers below and ask them to vote NO on any amendment to block Clean Water Act protections for our streams, lakes, and wetlands.

Since 2001, safeguards for headwater streams and critical wetlands have steadily eroded based on Supreme Court rulings and agency direction from the previous Administration that removed many waters from Clean Water Act protection. In Colorado alone, about 75 percent of rivers and streams—some 76,000 miles of waterways—are seasonal or ephemeral in nature and could fall outside the net of Clean Water Act protection based on rules changed in the 2000s, putting them at the mercy of filling and dredging operations, oil spills, toxic industrial waste and unregulated development.

More recently, the Army Corps of Engineers and Environmental Protection Agency have proposed new guidance that would restore protection to many of these waterways. While still constrained by the Supreme Court rulings, the new guidance ensures that more of our waterways are protected and provide greater clarity and efficiency in how the Clean Water Act is implemented. The new guidance is still well within the bounds of waters that were historically covered under the Clean Water Act since 1977, and maintains the historic exemptions that have enabled farmers, ranchers, and foresters to conduct their normal activities with regulatory certainty.

Despite the importance of this guidance and its reasonableness, Senators Barrasso and Heller are offering an amendment that would prevent the Corps or the EPA from continuing work on the administrative guidance and rulemaking. This would lock in place the Clean Water Act guidance from the previous Administration, keeping at risk 75 percent of Colorado’s rivers and streams.

Please call Senators Udall and Bennet – now – and ask them to vote NO on any amendment to block the Corps and EPA from restoring Clean Water Act protections for our streams, lakes, and wetlands.

Thanks Webby. I called Bennett and Udall on the way in to work this am. Gotta love the hands-free device and having our senators numbers on speed dial.
