I bought a Tributary/AIRE Tomcat off eBay. The listed condition was "NEW" on the auction. When it arrived late last week it was heavily scratched, gouged, torn stitching, filthy, stained, and covered in bird poop.

The seller is insisting that it is brand new and never used. This is his reply:

"I have had this item in storage for about 30 days. This item have never been used but has been moved from a store to a warehouse. I was hoping that the man that is warehousing these items was keeping them in the appropraite condition. I apologize for the condition, but once cleaned it will work graet on the water."

"This was an as is purchase. Item has been warehoused and nver used in the water and is operationally sound as a raft and has no holes or is not malfunctioning as a raft."

Again, the boat was listed as "NEW" and nowhere in the listing was "as is purchase" declared.

Please review the pics and let me know your thoughts? Frankly, I own 2 other Bandits and 1 Linx and they look in better shape used than this new Tomcat.

Did you pay with PayPal? File a complaint. Dispute resolution is weighted in favor of the buyer. I've only had to do it once and eBay/PayPal took care of me.

Hopefully it wasn't a low feedback seller who ripped off a few people and disappeared? Stay away from low feedback sellers and don't bid if they don't accept PayPal.

I think paypal protects you up to $500 for BS purchases. My friend had a similar situation. He filed a complaint, got his $ back and kept the item. Worked great for him! It takes a few days, but that is why you use paypal, for the "insurance." Good Luck.

Yes, I purchased w/ PayPal and am aware of the Resolution Center and the Insurance. I would not have purchased a high ticket item without PayPal. I've already opened a complaint w/ the Resolution Center after not getting a reply to my return email about not being pleased w/ his initial response of a simple apology and that it will still work great on the water.

I did get a good deal on the boat, but again, that's why I shopped for it on eBay. I just feel that the condition I received it in is far from the "NEW" condition that it was represented as. I could understand a few scuffs here and there. As you'll see from the pics, the condition looks far from new. If its never been used, how did it get looking this BAD. Did they drag it from behind a truck on the ground from the store to the warehouse. It has gouges going into the base cloth.

More or less, he feels that since I got a good deal and that it still floats, I should be happy!

I'm just wondering if you guys also feel that this guy is outright dishonest or is this a bit of a gray area?

If you paid with PayPal with your credit card, get in touch with your card issuer's dispute department and let them tell you next steps. This shit happens all the time and I always make sure I use my card through PP and not the PP direct debit to my checking account.

straight up dishonest BS. where is the seller from?? Whats the sellers ID?? this should be known for us buzztards. mainly so we can give a little karma back in that asses direction

extremely dishonest. definitely report him.

this isnt boating equipment but just in case anyone was looking to buy winter gear off ebay, please avoid the seller 'perguate'. i bought a 'north face' down jacket from them through paypal, it was a total fake, zipper broke as soon as i tried to zip it up. got refunded but had to pay to ship it back. thought id warn everyone.

ugh. no more looking for clothes on ebay, its too easy to get ripped off. lesson learned. got a 'real' winter jacket from the rei outlet. mountain hardwear, baby!

just because it's diet don't mean it's good for you!
