Clean Water Act

Hey all.

An issue I thought we all might be concerned about...

Act now to protect the Clean Water Act!


Little Sandy Dam, Sandy River
A hydropower dam owner in Maine has asked the U.S. Supreme Court (S.D. Warren v. Maine Board of Environmental Protection) to take away the state’s authority to protect rivers, fish, wildlife, water quality, and recreation at hydropower dams. If the dam owner wins, every state will lose the power to enforce the Clean Water Act at hydropower dams. Call your state’s Attorney General now and insist that he or she stand with Maine and stand up for rivers!

Since the main issue in this case revolves around a state’s authority over water quality within its borders, the court will care about what state governments have to say. The states of New York and Washington have been working together to prepare a brief for the Supreme Court in support of Maine’s position. But even more important than what the states say in the brief is how many states have signed onto the brief. Since the briefs are due during the holidays, your state Attorney General will need your encouragement to keep this vital case from slipping through the cracks.

American Rivers and Friends of the Presumpscot are also parties to this case, and will be filing a brief along with the state of Maine. Several other parties are also filing friend-of-the-court briefs.

what it CO AG saying?

American Whitewater is working on this as it could have a significant impact on our hydro program. To date, Colorado has not signed on (none of the adjoining states have either). Has anyone called in and what response have you received? If you call and have information to share please drop me a line okeefe AT amwhitewater.org
